Question: I took a breath test on scene before I was arrested, so why was I asked for another one at the jail?
Answer: The breath test you took on scene was most likely taken with what is known as a Portable Breath Test (PBT). The results of a PBT are not admissible as evidence regarding the specific numerical level of intoxication. However, a law enforcement officer may use the results of a PBT in order to determine if there is probable cause for an arrest. The breath test instrument used at the jail is different, and those test results are admissible as evidence against you, provided several evidentiary standards were met.
